Terms and Conditions

Dataxquare, S.L. (hereinafter Dataxquare), is an online service for managing different aspects of a business. These terms and conditions set out the rights and obligations of the user and Dataxquare as service provider.

Dataxquare will assume that any user who uses the service has read and accepted the conditions of use, and Dataxquare reserves the right to update and modify the Conditions of Use without any prior notice, which will always be available at the web address www.Dataxquare.com.

Dataxquare, with NIF B02649309 and address at Calle Simancas 39, 35010, Las Palmas de Gran Canaria, provides the Dataxquare Web Site and its related services in accordance with the terms set out below.

This Agreement shall be effective as of the date you check the acceptance of this Agreement box at the bottom of this document. Any new features that may be added to the Services shall be subject to the Terms of Use. Your continued use of the Service after any such modification shall constitute your agreement to such modifications. The most recent version of the Terms of Use will always be available at https://keytrends.ai/terms-of-service.

Failure to comply with any of the Terms of Use may result in termination of your account.

Account Conditions

To access the service you must be at least sixteen years of age (16).

A full legal name, email address, and all other information required by Dataxquare in the account creation process must be provided.

It is the responsibility of the user to provide truthful information, and Dataxquare reserves the right to delete any account, if it is suspected of being untruthful or may breach any of Dataxquare’s rules of use.

You are responsible for maintaining the privacy of your account. Dataxquare will not be liable for any damage or loss that may result from a user’s failure to protect their login information.

The parties agree to legally equate the customer’s autographic signature to that made by means of any other type of key, code or identifying security element. Notwithstanding the foregoing, the Service Provider may require written confirmation from the Customer when it deems it necessary.

Types of contracts

The contracting of a Dataxquare payment plan is initiated at the moment the user enters the card details and makes a first payment. No refunds or credits will be made under any circumstances.

The client is responsible for any contracting and therefore for evaluating each and every one of the functionalities, in no case are custom developments made and any information about new functionalities is merely informative and will not have any contractual link.

Once a payment plan has been contracted, it will automatically renew on the renewal date until the user deletes the account.

Dataxquare offers a fee system that adapts to the volume of keywords monitored by the user. The limits of each rate are specified in the pricing section at https://keytrends.ai#pricing . If the user exceeds any of the rate limits, the user will have to upgrade to a higher rate.

Dataxquare reserves the right to change the rates unilaterally at any time, without giving users any right to compensation.

Payment and access

A valid bank card is required to make payments. This is not required to create or use a free account. Dataxquare will charge you a recurring recurring fee depending on the type of account you have signed up for.

The Service is charged each period in advance, and is non-refundable. There will be no refunds or credits for partial months of the Service, nor will refunds be made in the event that the user does not make use of the Service during the period of time the account is open. No exceptions will be made under any circumstances.

The customer agrees that it shall not be necessary to confirm receipt of the acceptance of the contract when the contract has been concluded exclusively by electronic communication.

In the event that the user upgrades his account level due to his volume of documents, his card will not be debited with the new amount until the next billing date. Thereafter, your card will be charged for the new amount at the next billing date, unless the account is cancelled.

In the event of non-payment or return of the receipt, you will be notified of the non-payment and will automatically lose the ability to access the Service. The data will be deleted after thirty (30) days from the date of non-payment.

No fees include any taxes or duties required by your governmental authorities. The user is responsible for the payment of these taxes or duties. The user decides who has the right to log in to their account in whatever role they deem appropriate.

Service and plan modifications

Dataxquare reserves the right to modify or suspend, temporarily or permanently, the Service at any time for any reason with or without notice as it sees fit. Dataxquare reserves the right to change monthly fees with 15 days notice. Notices of fee changes will be posted on Dataxquare’s website and in writing.

Cancellation and termination

You are responsible for the proper termination of your account. You can cancel your account at any time via the Settings > Account > Delete menu. Once your account is deleted, all of your content will be deleted after thirty (30) days. You may cancel your account at any time, but you will be responsible for all charges incurred up to that point, including the full monthly charge for the month in which you discontinue service. Thereafter, no further charges will be made. Dataxquare reserves the right to terminate an account or prevent the use of the Software by anyone in breach of these terms of use.

Copying and intellectual property rights

Dataxquare owns all Intellectual Property rights in any and all protectable components of the Service, including but not limited to the Service name, artwork, all software associated with the Service and user interface elements contained in the Service, many of the individual features and related documentation. You agree not to copy, adapt, reproduce, distribute, reverse engineer, decompile, or disassemble any facet of the Service that Dataxquare owns. The user also agrees and undertakes not to use robots, spiders, other automated devices, or manual processes to monitor or copy any content of the Service. Dataxquare will not claim any rights to the Intellectual Property of the Content that you upload or provide to the Service. However, by using the Service to submit content, the user agrees that third parties may view and share this user-submitted content.

Terms and conditions

The user is fully responsible for the access and correct use of Dataxquare subject to the current legislation, whether national or international, as well as to the principles of good faith, morality, good customs and public order. And specifically, he/she acquires the commitment to diligently observe the present General Conditions of Use.

You agree not to resell, duplicate, reproduce or exploit any portion of the Service without the express written consent of Dataxquare. User may not use the Service to store, host, or send harmful or unsolicited email (spam).

You understand that the Service may be used for the transmission of your Content, and that during this process, your Content, including invoices, payment notices, and personal messages, may be transferred unencrypted over the Internet. You may not use the Service to transmit any viruses, worms, or any other malicious or harmful content.

Dataxquare makes no warranties regarding your ability to use the Service, your satisfaction with the Service, that the Service will be available at all times, uninterrupted, and error-free, the accuracy of mathematical calculations performed by the Service, and the correctness of Service errors.

Neither Dataxquare, its partners, nor its sponsors are liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, or other damages of any kind arising out of or in any way connected with your use of the Service. You can only remedy your dissatisfaction with the Service by discontinuing use of the Service and terminating your account.

If any of the conditions described here are invalidated or cannot be applied, the application of any of the remaining conditions shall in no way be affected.

The Terms of Use establish an absolute understanding between you and Dataxquare with respect to the Service and supersede any prior agreements reached between you and Dataxquare. The Terms, and your relationship with Dataxquare under these Terms, shall be governed by the laws of Spain. You and Dataxquare agree to submit to the exclusive jurisdiction of the courts of Las Palmas de Gran Canaria to resolve any legal matter in connection with the Terms.

Security and privacy

Dataxquare S.L. is duly registered with the Spanish Data Protection Agency, thus complying with current legislation on confidentiality and security of confidential data.

The data that users enter on Dataxquare is hosted on Google servers in the European Union, thus guaranteeing both data hosting regulations and the highest levels of security and accessibility on the market.

Dataxquare S.L. and its employees have access to the account data in order to improve the service and to offer a good support service. All Dataxquare employees and partners have signed a confidentiality agreement in compliance with privacy regulations including the GDPR.

Return policy

Monthly Subscriptions: If at any time during the first 30 days of using Dataxquare you are not satisfied with the service, please contact us at hello@keytrends.ai. We will do our best to find a solution to your needs, and if this is not possible, we will refund your first month’s subscription.

Annual Subscriptions: Dataxquare does not require an annual subscription. We prefer that you have the choice. In return for taking out an annual subscription and as a thank you for your commitment, we offer a significant discount on our already competitive rates. If during the first 30 days after signing up for your annual subscription you are not satisfied with the service, please contact us at hello@keytrends.ai. We will do our best to find a solution to your needs, and if this is not possible, we will refund your money.

Renewal of subscriptions: For your convenience, subscriptions are automatically renewed until you cancel your subscription. We know that sometimes customers forget about a subscription that they do not wish to renew and that has already been charged, so we offer 7 days from the renewal date, during which time we will refund the money for the renewed subscription if you request us to do so through the aforementioned section hello@keytrends.ai.

Exception to our refund policy: We will not accept refund requests from users whose service has been suspended or terminated by us for breach of our terms and conditions.
